If applicable:

For the prices that are on our website, we strive to be as accurate as possible a representation of the reality and the intended prices. Errors that arise and are recognizable as programming or typing errors, never form a reason to be able to claim or assume a contract or agreement with Elvira Clement.

Elvira Clement strives for the most up-to-date website possible. If, despite these efforts, the information or content on this website is incomplete and / or incorrect, we cannot accept liability for this.

Amendments

If these terms and conditions change, you will find the most recent version of the ElviraClement.com disclaimer on this page.

Quotations, prices, payments and invoicing

All offers and quotations by Elvira Clement are entirely without obligation. Elvira Clement is only bound by the offers if the acceptance thereof is confirmed in writing by the client within 14 days.

All prices on the website are expressed in Dollars and are always excluding VAT. The price that is invoiced is the price that has been agreed in advance, possibly plus the costs for additional work for which the customer has given his written permission.

In connection with the digital transmission of the invoice, the customer is obliged to provide a properly functioning e-mail address. If the customer fails to make the payment, Elvira Clement may, without being obliged to give further notice, decide to hand over the claim for collection. The costs involved are for the account of the customer.

Cancellation

If the customer cancels the order after giving approval, the customer is obliged to pay the full amount stated in the quotation. Before canceling, always contact us first to discuss whether there is a possibility to still perform the assignment to your satisfaction.

Delivery conditions and delivery time

During the development phase, the customer is given the opportunity to make comments and suggestions, or to propose changes, unless otherwise agreed in writing. The changes specified by the customer may not be of such a nature that they actually create a new order. Changes are therefore understood to mean: small changes within the existing assignment. Remarks and comments and proposals for changes submitted after the feedback round can be seen as additional work and can only be included if the customer has agreed in writing to the additional work and the agreed remuneration. On average, Elvira Clement strives to have custom designs completed within two weeks, if it is clear that this period of time cannot be achieved, you will be notified by e-mail.

Force majeure

It is possible that Elvira Clement cannot perform an assignment due to force majeure. If that is the case, you will not receive an invoice for this as a customer. However, because it concerns force majeure, Elvira Clement is also not liable for any damage caused by not being able to perform the assignment. In the event of a force majeure situation, we will discuss with you how a mutually satisfactory solution can be reached for both parties.

Complaints

Do you have a complaint? That is of course very annoying. Report your complaint immediately, preferably by email, whereby the complaint is described as closely as possible. Every effort is made by Elvira Clement to reach a solution in mutual consultation and to resolve the complaint. Complaints about delivered works can be reported up to 14 days after delivery. After this, the right to claim expires.
